These Terms & Conditions (“Terms”) govern your use of Guava (“Guava,” “we,” “us”) and the service that generates a one-page website from a business’s public Google listing (the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service
You paste a Google Maps link and we generate a one-page website using publicly available business details and reviews retrieved from Google, analyzed and assembled with AI. The Service is provided on an “as is” and “as available” basis.
Acceptable use
- Only generate pages for businesses you own or are authorized to represent, or for legitimate, lawful purposes.
- Do not use the Service to infringe others’ rights, to mislead, or to violate any law or third-party terms (including Google’s).
- Do not attempt to disrupt, reverse engineer, scrape, or overload the Service.
Third-party content & Google
Business details, photos, ratings, and reviews are sourced from Google and belong to Google and/or their respective authors. They are displayed with attribution and remain subject to Google’s terms. We do not claim ownership of that content, and you must not remove attribution. Your use of Google-derived content must comply with applicable Google policies.
Accuracy
We design the Service to use only claims supported by real reviews and verified business details, and we run an automated verification step. Even so, we do not warrant that generated content is complete, current, or error-free, and you are responsible for reviewing a page before relying on or publishing it.
Your edits & content
You can edit your site yourself. You are responsible for any content you add or change, including ensuring it is accurate, lawful, not misleading, and that you have the right to use it. We may remove content that breaches these Terms or any law.
Intellectual property
The Service, including its software and design, is owned by Guava. Subject to these Terms, we grant you a limited, non-exclusive, revocable license to use pages generated for your business. Content sourced from third parties remains owned by those parties.
Subscriptions & billing
Plans, prices, and features are shown on our pricing page and at checkout. Prices are shown in the currency stated at checkout (currently Australian dollars, AUD), with no setup fee. Paid plans begin with a 14-day free trial; after the trial, the subscription renews automatically (monthly or yearly, as chosen) until you cancel. You can cancel anytime from your dashboard, effective at the end of the current billing period (we don’t pro-rate part-periods). If you cancel or your subscription lapses, your site is taken offline (unpublished) and you can reactivate it later. We may change prices or features with reasonable notice. Except where non-refundable fees are prohibited by applicable law (see “Consumer rights” below), fees already paid are non-refundable.
Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Service may be modified, suspended, or discontinued at any time.
Limitation of liability
To the maximum extent permitted by law (and subject to “Consumer rights” below), Guava will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Service. Where our liability can be limited, our total liability for any claim will not exceed the amount you paid us in the 3 months before the claim arose.
Consumer rights
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the mandatory consumer protection laws of your jurisdiction that cannot lawfully be excluded. Where our liability for failing to meet such a guarantee can be limited, it is limited, at our option, to re-supplying the Service or paying the cost of having it re-supplied.
Indemnification
You agree to indemnify and hold Guava harmless from claims arising out of your use of the Service or your violation of these Terms or any third-party rights, including any claim that you were not authorized to generate a page for a given business.
Governing law
These Terms are governed by the laws of Australia, where Guava is established, without regard to conflict-of-laws rules. You submit to the non-exclusive jurisdiction of the Australian courts, and nothing here removes any right you have to bring proceedings in your own country where mandatory local law allows.
General
These Terms are the entire agreement between you and Guava regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
